Вчера решением суда были назначены 2 временных администратора. Часть судов (9) будут готовить к продаже, овнерские суда будут менять менеджмент, основная часть оставшихся судов пока останется под Флинтером. Про Навигию официальной информации нет. До всех этих дел у них было какие то партнерские контакты на уровне CEO. Обязательства перед моряками будут выполнены,согласно MLC. Хочется в это верить. | |

Dear All,
In order to keep you updated with the latest information received, please
be advised
as follows:
On Wednesday, 19th October 2016, the Rotterdam Court ruled over the filed
request
for suspension of payment and appointed 2 administrators. These 2
administrators are
now running the Company together with our Board and yesterday it was their
first day
in the office. They have informed the office staff the way forward with the
bankruptcy and the possible scenarios to follow. At present, these 2
administrators
will assess the situation and expect that next week to file for bankruptcy
for the
companies where a suspension of payment has been submitted for: Flinter
Groep BV,
Flinter Shipping BV and Flinter Management BV, Flinter Shared Services,
Flintersky,
all the 8 vessels owned by Flinter Fleetholding (Arctic, America, Bothnia,
Gerarda,
Orcana, Rose, Spirit, Sun) and other Flinter companies. Until the
bankruptcy of
Flinter Management is confirmed, Flinter Management remains the ISM DOC
holder of
all vessels in our management.
In the first place, the administrators will join our Board to ensure
proper steps
are taken to protect the interests of various parties claiming a share in the
bankrupt companies. If/when the bankruptcy is confirmed, then these 2
administrators
will be running the Company. At the same time, we also expect the shore
personnel to
receive a notice of termination for the employment contracts and a limited
team of
office staff to be appointed in order to will deal with the running
matters. This
staff has to deal with the following:
1. Regarding the ING vessels, a delivery in port of choice of ING will be
taken care
off. After delivery preparation to and sale of the vessels will be
arranged where
after all contracts will end. The vessels financed by ING are; F'Bothnia,
Gerarda,
Orcana, F'Rose, F'spirit, F'Sun, F'Sky, F'America, F'Arctic. Those vessels
are
instructed by their operators how to proceed.
2. Regarding UAL vessels, Mario Primo, Flinterridhi and Flinter Ruby; it
is up to
the owners to decide whether we will try to take care of the management of
the
vessels or they will choose to change management. The owner of Mario Primo
has
already decided to change to Q-shipping and Flinterridhi will be managed
by JR
Shipping, therefore a smooth transfer has to be in place.
3. The remaining Flinter vessels will be operated by our staff as far as
reasonably
possible. In due time, the owners will decide whether to continue or change
management, however this is subject to the administrators.
Please note that based on MLC, the crew onboard has the first rights on
the vessel
with regards to wages payment.
As for the shore personnel, although we have not received our October
salary, we are
all being asked to come to the office and continue our work until we
receive a
formal notice of termination.
There are still many unclarities for us as well and we do not have the
answers to so
many questions, but we will keep you informed as much as reasonably
possible and as
long as we can remain in position.
